Commerce
Terms of Service
This is my "Terms of Service" for all business transactions, such as character sales/resales and art commissions.
In General
I may refuse or cancel service for any time and for any reason. Refunds will be given when necessary.
I try to be friendly and respectful. While I don't expect you to be my best friend ever, I do expect you to act normal while I work with you (i.e. don't be rude, don't be flirty, don't start venting unprompted, don't try to roleplay with me, etc.) and I will stop interacting with you if you make me too uncomfortable.
Once the sale/trade/service is complete, please do not be disappointed if I am not interested in continuing to chat with you. I am a very tired and shy person, and unless we already have an established relationship or we somehow really hit it off, I probably don't have the energy to make a new friend.
Offering Guidelines
Offers must be specific and actually needs to give me information that I can use to negotiate.
Examples of good offers:
- $10
- 1 fullbody, 1 icon, and $15
- Any character in this folder and up to $20 depending on the value of the one you like
- This character, this character, or this character, or 2 icons + a half-body, or $45
- Art of your choice with a value of around $50, based on my pre-existing commission prices
Examples of bad offers:
- I can offer art
- This means literally nothing.
- Anyone on my entire account except for X folder and X tag and any cat character and
- Confusing and overwhelming. Just sort the ones you're willing to offer into a folder or link them directly.
Art Permissions
Commissions and art trades are closed indefinitely.
I retain full rights to every art piece I have ever made. I am allowed to do whatever I want with it. If you would like me to link you as the owner of your character or the creator of your character when I share it, I will do so happily.
If I've drawn your character, you may use that drawing for any non-commercial purpose such as printing it out for display in your home, profile pictures, etc. as long as you give credit wherever it is publicly visible. You may also add the price you paid for it to the "total value" of your character and take that into account should you resell the character.
You may not use it for any other purpose involving money, including selling prints, posting it behind a paywall (such as Patreon), or in monetized YouTube videos.
You may do the latter if and ONLY if you receive my express permission. You may have to pay an additional fee.
Bases & Other Assets
I do not have control over who uses my assets and am not necessarily associated with anyone who is using or has used them.
Assets that are free-to-use (F2U) may be used and distributed freely by anyone and everyone forever, as long as I am given credit.
Assets that are pay-to-use (P2U) may be used freely by anyone who has ever purchased them forever, as long as I am given credit, but you may not re-distribute them.
For clarity: you sharing the raw PSD or un-colored linework is re-distribution; you coloring in the base for your friend and giving them the colored version or trading away an adoptable that has used the base is not re-distribution and is perfectly acceptable.
Please link directly to the asset that you used when giving credit so that others that want to use it can find it quickly.
Terms of Use
This is my "Terms of Use" for adoptable characters. This applies to characters created by me that you have purchased.
Usage in General
Once you have it, it's yours to draw/write about however you like. Just credit me as the character designer if used commercially (monetized YT videos, merch, fursuit sale, etc.) and don't claim you made it yourself. I would also prefer if you told me if you intend to use a character commercially, but I don't track my designs and don't really care what you do with them.
If you don't use a character made by me, I'd prefer if you rehomed them rather than just letting them rot, but that's just a request and I won't get upset if you don't.
Also, don't try to claim any ownership of characters that are not yours:
- Don't apply or enforce your own terms of use or sale after you've resold it (For example: You can say "don't draw gore of my character" while you own it, but you can't tell people not to draw gore of that character after you sell it; You can say "you have to buy these characters together" while you still own them, but you can't tell people to keep them together after they're out of your hands).
- Don't tell people they aren't allowed to be inspired by my designs (Inspiration is getting your own idea upon seeing someone else's; it's not the same as just copying the character. You don't own any one concept and you certainly don't get to claim total ownership of any that you didn't even come up with).
None of these things are or ever were enforceable by you anyway, and this part of the TOU basically just serves as an extra line of defense.
Credits and Ownership
Pertaining to Toyhouse specifically, please see the respective section on my Toyhouse TOU.Please link my website (SecretDragon.Pink) as credit where applicable, such as character profiles and sale pages where the character is displayed.
Co-owning makes assisting with disputes complicated and inconvenient, so I do not consider it valid. I have never recognized co-ownerships and this applies to all of my designs. If you get caught up in a scam related to co-owning one of my designs, neither I nor my Terms of Use will protect you.
Blacklist
DO NOT use this list as an excuse to post about or directly harass anyone. Block them if you wish, but do not start extra drama on my behalf.
I do not strongly enforce a blacklist because it is time consuming and draining, however I would prefer if the following users did not receive any of my designs:
- Murky/Fuckass - Scammer, charged back upwards of $100 total from multiple people including myself; PayPal gave me my money back but others weren't as lucky.
- StarlightSlaughter - Harassment, transphobia, and lying about people they don't like 5+ years later because they got mad that they were banned from their community.
